1. INTRODUCTION AND SCOPE

Welcome to Elusive Realty Homes. By accessing our website, engaging our brokerage services, or entering a rental agreement managed by us, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between the Client (“you”) and Elusive Realty Homes (“we,” “us,” or “our”).

2. WEBSITE CONTENT AND ACCURACY

  • Informational Purpose: Property listings, floor plans, and market data provided on our site are for informational purposes. While we strive for accuracy, Elusive Realty Homes does not warrant that descriptions, pricing, or availability are error-free.

  • Third-Party Links: Our site may contain links to third-party mortgage calculators or insurance providers. We are not responsible for their content or privacy practices.

3. REAL ESTATE BROKERAGE SERVICES

  • Agency Relationship: A formal agency relationship is only established once a written Listing Agreement or Buyer Representation Agreement is signed by both parties.

  • Fair Housing: Elusive Realty Homes strictly adheres to Fair Housing Laws. We do not discriminate based on race, color, religion, sex, handicap, familial status, or national origin.

  • Due Diligence: While we provide expert guidance, it is the buyer’s responsibility to conduct inspections, title searches, and appraisals.

4. SHORT-TERM RENTAL & LEASING TERMS

For clients booking “Elusive” vacation stays or managed rentals:

  • Booking Deposits: A deposit (typically 20–50%) is required to secure a reservation. Payment constitutes acceptance of the house rules.

  • Security Deposits: A refundable security deposit may be held to cover potential damages. This will be released within 7–14 days post-departure, pending a property inspection.

  • Cancellations: * Cancellations made 60 days prior to check-in: Full refund minus a $100 admin fee.

    • Cancellations made within 30 days: 50% refund.

    • Cancellations made under 14 days: Non-refundable.

5. PAYMENTS AND FEES

  • Currency: All transactions are processed in USD ($) unless otherwise specified.

  • Late Fees: For rental payments or service retainers, a late fee of 5% may be applied if payment is not received within 3 days of the due date.

  • Admin Fees: A standard $100 administrative fee applies to contract modifications, name substitutions, or booking transfers.

6. CONDUCT AND LIABILITY

  • Property Access: Clients must follow all safety protocols during property tours. Elusive Realty Homes is not liable for injuries sustained during unauthorized entry or “self-guided” tours.

  • Damage to Property: Clients are financially responsible for any damage caused to a property during a viewing or a managed stay.

  • Force Majeure: We are not liable for delays or cancellations caused by “Acts of God,” including natural disasters, pandemics, or sudden government zoning changes.

7. PRIVACY AND DATA

Your privacy is paramount. We collect personal data solely to facilitate real estate transactions. We do not sell your information to third-party marketers. For more details, please refer to our Privacy Policy.

8. GOVERNING LAW

These terms are governed by the laws of the jurisdiction in which Elusive Realty Homes is registered. Any disputes shall be resolved through binding arbitration before seeking litigation.

  5. Closing/Check-in: The final transfer of keys or funds.
